Frequently asked questions

Once the lasting power of attorney has been signed, it must be registered with the Office of the Public Guardian before it can be used. The registration process typically takes several weeks because the application goes through a formal review and waiting period. As part of our fixed fee service, we submit the application and manage the registration process for you. This ensures the documents are completed correctly and helps avoid delays that can arise if forms are prepared incorrectly.

It allows someone you trust to make decisions on your behalf if you are no longer able to do so yourself. Our fixed fee service prepares the document, ensures it is signed correctly and registers it with the Office of the Public Guardian. This provides reassurance that your LPA is legally valid and ready to be used when needed.

There are two types of lasting power of attorney. A property and financial affairs LPA allows someone you trust to manage financial matters such as bank accounts, bills and property. A health and welfare LPA allows decisions to be made about medical treatment and care. Many people choose to put both in place so that someone they trust can assist with both financial and personal decisions if necessary. Our solicitors can explain the differences and help you decide which option is right for you.

A simple lasting power of attorney is intended for straightforward situations. If you want to appoint multiple attorneys, include specific instructions or restrictions, or add detailed provisions about how decisions should be made, a more tailored LPA may be appropriate. In those circumstances our solicitors can advise on preparing a bespoke lasting power of attorney that reflects your wishes and provides the appropriate legal protection.
